Terms of Service for NordLyd Podcaststudio
These Terms of Service ("Terms") govern the use of services provided by NordLyd Podcaststudio, with registered business address at Thorvald Meyers gate 7, 0555 Oslo, Norway, email [email protected], and telephone +47 23 45 67 89 (the "Service Provider"). By booking, accessing, or using any service offered by NordLyd Podcaststudio, the customer ("Customer") agrees to be bound by these Terms.
1. Introduction and acceptance of terms
These Terms constitute a binding agreement between the Customer and NordLyd Podcaststudio regarding the use of the Service Provider’s podcast studio and related production services. If the Customer does not agree to these Terms, the Customer must not use or book the services.
By confirming a booking, attending a session, paying an invoice, or otherwise using the services, the Customer confirms that they have read, understood, and accepted these Terms.
2. Scope of services
NordLyd Podcaststudio provides podcast production-related services, including but not limited to:
- Leie av lydisolert podcast-rom
- Opptak med profesjonell mikrofon- og lydteknikk
- Teknisk bistand under innspilling
- Redigering og etterarbeid av episoder
- Videopodcast-opptak med fler-kameraløsning
- Rådgivning for format, struktur og publiseringsflyt
The exact scope, duration, deliverables, technical setup, and any additional services shall be specified in the booking confirmation, quotation, order form, or other written agreement. Any services not expressly included are excluded unless agreed in writing.
The Service Provider may use subcontractors or external suppliers to perform parts of the services, provided that this does not materially reduce the agreed service level.
3. User obligations and responsibilities
The Customer is responsible for ensuring that all participants, guests, speakers, and other persons attending a session comply with these Terms and any studio rules communicated by the Service Provider.
The Customer shall:
- Provide accurate and complete booking information.
- Arrive on time and ensure that all participants arrive on time.
- Use the studio, equipment, and facilities with due care.
- Follow all instructions from studio personnel regarding safety, technical operation, and studio conduct.
- Not bring prohibited items, including illegal substances, dangerous goods, open flames, or equipment that may damage the studio or interfere with recording.
- Ensure that any content recorded does not infringe third-party rights or violate applicable law.
- Obtain all necessary consents, releases, and permissions from guests, contributors, and other persons appearing in or contributing to recordings.
The Customer is liable for damage caused by the Customer, participants, guests, or any third party under the Customer’s control, except to the extent such damage is caused by the Service Provider’s gross negligence or wilful misconduct.
The Customer shall not use the services for unlawful, defamatory, discriminatory, harassing, threatening, or otherwise objectionable content, or for content that violates the rights of others.
4. Payment terms and conditions
Prices are as stated in the relevant quotation, booking confirmation, price list, or invoice. Unless otherwise agreed in writing, prices are stated in Norwegian kroner (NOK) and may be subject to applicable taxes, including VAT where relevant.
Unless otherwise agreed:
- Payment is due in accordance with the invoice terms stated by NordLyd Podcaststudio.
- The Service Provider may require advance payment, deposit, or full prepayment before the session or delivery of edited material.
- Late payments may incur statutory default interest and reasonable collection costs in accordance with applicable Norwegian law.
- The Service Provider may suspend or withhold services, recordings, files, or delivery of edited content until outstanding amounts are paid in full.
Any additional time, extra editing, rescheduling, equipment use, or other services requested by the Customer beyond the agreed scope may be charged separately.
5. Cancellation and refund policy
Cancellations and rescheduling requests must be made in writing to NordLyd Podcaststudio. The following rules apply unless a different policy is expressly stated in the booking confirmation:
- Cancellations made more than 7 days before the scheduled session may be eligible for a full or partial refund, less any non-recoverable costs already incurred.
- Cancellations made between 7 days and 48 hours before the scheduled session may be subject to a cancellation fee.
- Cancellations made less than 48 hours before the scheduled session may be charged in full.
- No-shows or failure to attend at the agreed time may be charged in full.
If the Service Provider cancels a session for reasons within its control, the Customer will be offered a rescheduled session or a refund of amounts paid for the cancelled service, as the Customer’s sole remedy, unless otherwise required by law.
Refunds do not apply to services already performed, custom work completed, or non-recoverable third-party costs incurred on behalf of the Customer, unless mandatory law provides otherwise.
6. Liability limitations
To the fullest extent permitted by applicable law, NordLyd Podcaststudio shall not be liable for indirect, incidental, consequential, special, or punitive damages, including loss of profit, loss of business, loss of data, or reputational harm, arising out of or in connection with the services.
The Service Provider does not guarantee uninterrupted operation of equipment, perfect audio/video quality in all circumstances, or that recordings will be free from technical issues beyond reasonable control. The Customer acknowledges that recording and production services may be affected by factors such as participant behavior, external noise, equipment failure, software errors, or internet disruptions.
Except in cases of gross negligence or wilful misconduct, the total liability of the Service Provider for any claim arising from or related to the services shall be limited to the amount paid by the Customer for the specific service giving rise to the claim.
Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is not permitted under applicable law, including mandatory consumer protection rules where applicable.
7. Intellectual property rights
Unless otherwise agreed in writing, all pre-existing intellectual property rights in the Service Provider’s equipment, templates, workflows, methods, branding, software configurations, and studio materials remain the property of NordLyd Podcaststudio or its licensors.
Subject to full payment of all amounts due, the Customer receives a non-exclusive right to use the final delivered recordings and edited materials for the Customer’s own lawful podcast, marketing, and publication purposes, unless a different license is agreed in writing.
The Customer represents and warrants that it has all necessary rights to any content, music, logos, images, scripts, guest contributions, and other materials supplied by the Customer or used in the recording. The Customer shall be solely responsible for clearing rights and obtaining permissions for such materials.
The Service Provider may retain copies of recordings and project files for backup, quality assurance, dispute handling, and operational purposes, subject to applicable data protection law and any agreed retention periods.
8. Data protection and privacy
NordLyd Podcaststudio processes personal data in accordance with applicable Norwegian and EEA data protection laws, including the General Data Protection Regulation (GDPR) where applicable.
Personal data may be processed for purposes including:
- Managing bookings and customer relationships
- Providing and delivering services
- Invoicing and accounting
- Communicating with the Customer and participants
- Maintaining security, quality control, and technical support
- Complying with legal obligations
Where recordings include identifiable persons, the Customer is responsible for informing participants and obtaining any required consents, unless the Service Provider has expressly agreed in writing to handle such notices or consents.
Further details regarding data processing, retention, and rights of data subjects may be provided in a separate privacy notice. In the event of inconsistency, mandatory law shall prevail.
9. Force majeure
Neither party shall be liable for failure or delay in performing its obligations to the extent caused by events beyond its reasonable control, including but not limited to fire, flood, power failure, internet outage, labor disputes, illness, war, terrorism, governmental action, natural disasters, or serious equipment failure not caused by negligence.
If a force majeure event prevents or materially delays performance, the affected party shall notify the other party as soon as reasonably practicable. The obligations affected shall be suspended for the duration of the force majeure event. If the event continues for an unreasonable period, either party may terminate the affected service by written notice, without liability except for payment for services already performed and non-recoverable costs incurred.
10. Changes to terms
NordLyd Podcaststudio may update or amend these Terms from time to time. The updated Terms will take effect from the date stated in the revised version or, if no date is stated, upon publication or communication to the Customer.
For ongoing services or future bookings, the version of the Terms in force at the time of booking shall apply unless otherwise agreed in writing. Continued use of the services after changes have been communicated constitutes acceptance of the updated Terms to the extent permitted by law.
11. Applicable law and jurisdiction
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of Norway.
Subject to mandatory consumer rights and any applicable alternative dispute resolution procedures, the parties agree that disputes shall be subject to the exclusive jurisdiction of the courts of Oslo, Norway.

13. Severability clause
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a competent court or authority, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
If any invalid or unenforceable provision can be lawfully replaced by a valid provision that most closely reflects the original intent, the parties shall be deemed to have agreed to such replacement to the extent permitted by law.
